Terms of Service — Paddock Pass

1. Agreement to Terms

By creating an account or using the Paddock Pass application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the service. We may update these Terms from time to time and will notify you within the App. Continued use after an update constitutes acceptance.

2. Eligibility

You must be at least 13 years old to use the App. If you are under 18, a parent or legal guardian must review and agree to these Terms on your behalf.

3. Account Registration

You must create an account using a valid email address or a supported sign-in provider (Apple, Google). You are responsible for maintaining the confidentiality of your credentials and all activity under your account. You may not create multiple accounts, impersonate others, or share your account.

4. Description of the Service

Paddock Pass is a free-to-play fantasy sports game based on real Formula 1 race results. You build a virtual team of drivers, a constructor, and a powertrain supplier within a virtual budget cap, earn points based on real race outcomes, and compete in private or public leagues.

No real money is wagered, won, or lost. Paddock Pass is not a gambling service. All competition is for entertainment purposes using virtual points only.

Race data is sourced from third-party providers after each session ends. We do not provide live, real-time data. All scoring and game logic runs on our servers.

5. User Conduct

You agree not to:

Use the App for any unlawful purpose.
Attempt to gain unauthorized access to the service, other accounts, or our infrastructure.
Use automated tools, bots, or scripts to interact with the App.
Harass or threaten other users through any in-app content.
Exploit bugs or scoring errors for competitive advantage.
Reverse engineer or disassemble the App or its backend services.

We reserve the right to suspend or terminate accounts that violate these rules.

6. Leagues and User-Generated Content

You are responsible for the content you create (league names, icons, settings). We reserve the right to remove content that is offensive or violates these Terms. We do not mediate disputes between league members.

7. Intellectual Property

The App, including its design, code, and branding, is the property of Nicholas Daniele and is protected by applicable intellectual property laws.

Paddock Pass is an unofficial fan project and is not affiliated with, endorsed by, sponsored by, or connected in any way with Formula One Licensing B.V., the FIA, Formula One Management Ltd., or any Formula 1 team or driver. F1, FORMULA ONE, FORMULA 1, FIA FORMULA ONE WORLD CHAMPIONSHIP, GRAND PRIX and related marks are trademarks of Formula One Licensing B.V. Driver names, team names, and constructor names are used solely for identification purposes and remain the property of their respective owners.

You retain no ownership rights to any virtual teams, scores, or in-game assets. These exist solely within the service.

8. Data and Privacy

We collect and process personal data as described in our Privacy Policy. We do not sell your personal data to third parties.

9. Service Availability and Disclaimers

The App is provided "as is" and "as available" without warranties of any kind. We do not guarantee uninterrupted service, the accuracy or timeliness of race data, or error-free scoring. Scoring corrections may occur after steward decisions. We may modify, suspend, or discontinue the App at any time.

10. Account Deletion

You may delete your account at any time through Settings in the App. Deletion permanently removes your user record and personal information. Historical game data is anonymized. Account deletion is irreversible.

11. Limitation of Liability

To the maximum extent permitted by law, Nicholas Daniele and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability is limited to the amount you paid us, which for a free service is zero.

12. Governing Law

These Terms are governed by the laws of the State of Rhode Island. Any disputes not resolved informally shall be brought in the state or federal courts of Rhode Island.

13. Termination

We may suspend or terminate your account at any time for violation of these Terms. Upon termination, your right to use the App ceases immediately. Sections covering Limitation of Liability, Intellectual Property, and Governing Law survive termination.

14. Changes to the Service

We may change game rules, scoring systems, and other game parameters at any time to improve balance or fix issues. Such changes are not a breach of these Terms.

15. Apple-Specific Terms

This section applies if you download the App from the Apple App Store.

These Terms are between you and Nicholas Daniele, not Apple Inc. ("Apple"). Apple is not responsible for the App or its content.
Apple has no obligation to provide maintenance, support, or warranty services for the App.
In the event of any failure of the App to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any). Apple has no other warranty obligation with respect to the App.
Apple is not responsible for any claims relating to the App, including product liability, regulatory compliance, or consumer protection claims.
Apple is not responsible for any third-party intellectual property infringement claims related to your use of the App.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you upon your acceptance.
